disaster. max baucus is calling for major changes in the program now in enrollment numbers for the firs few days of the obamacare rollout are dramatically disappointing for the administration. the white house has been telling us for months that millions of americans have been visiting health care.gov, but thehouse oversight committee released internal notes from meetings that show only six people in total successfully enrolled on the first day enrolled. obamacare is a train wreck that has become a laughingstock as a result. as of today, the white house pushed back expectations, taping them down and jay carney said that we don't expect those numbers to be very high and we

never did. ed henry is at the white house with our report. reporter: embarrassed over the rollout of president obama signature domestic achievement that only six people signed up on day one and was criticized by congressman darrell issa. >> the are no doubt there from a contractor about figures. if the website wasn't working on october 1, that is a dog bites man story i said demanded to know why a parade of top officials including kthleen

sebelius did not give the information. >> if you have internal numbers and you're not willing to hear extra numbers, you are doing the kind of propaganda that this administration has done since day one. reporter: they say it will take a couple of weeks to nail down the details. >> why don't you put out a reasonable preliminary number and show us some transparency. >> we have a reasonable and accurate number as we promised we would on a monthly basis, consistent with the data release that you see other programs. the focus here is understandable on how low the number might be.

reporter: jay carney said the republicans want to focus on the bad news and that democrats knew that would be slow at first but would pick up over time. the pressure to be transparent as coming from long time supporters of the affordable care act blasted the broader rollout with cnbc. >> and is off the rails and i think what the country needs right now is honesty and transparency and truth about what is really going on. reporter: oddly enough it was a comedy show that first throughout the number six last weekend. >> millions of people are visiting, it was only designed to handle six users at a time. reporter: the white house has shown no sign of a green to this

lou: a new government watchdog report shows the centers for medicare and medicaid services wrongly paid out $20 million to health care organizations on behalf of dead people. they are the agency in charge of implementing obamacare. the government waste and abuse does not end there. a separate report finds employees at the department of homeland security that have used overtime pay policies that have cost taxpayers $8.7 million per year in the dh budget this year is $60.8 billion. the reports show college students nationwide are experiencing obamacare sticker shock. community colleges in new jersey, once among the hundreds of educational institutions nationwide offered cheap health insurance to their students would have had to drop the practice because obamacare prohibits the sale of those

insurance policies now. more vidence of the health care law is potentially going to disrupt the budget and medicaid itself and an overwhelming majority of people applying for an expansion of medicaid as opposed to applying in the number of states. looking at the startling numbers, and parolees, medicaid, 82,000 of private insurance enrollments, 3000, arkansas over 70,000 and we are beginning to understand that that means embarrassingly small. none in the private insurance and washington, this is an

entirely upside down ratio between medicaid and 25,000 in kentucky and 6000 private. the next congressman is our guest and he's a member of the republican study committee. it's great to have you with us. now, how do you feel that no one seems to be able to move this administration to release the enrollment numbers? >> i find it appalling and eight letters for my district alone represent us. that is a larger number that i can show you here tonight, a larger number than the government can show that have signed up for obamacare across the country. so it's ridiculous, especially in the i.t. world. there is no more transparent way to get the accurate numbers quickly than through a website

and it's not supposed to be a paper system, it shouldn't be that hard and i think they are hiding something. lou: the house oversight committee has demonstrated that they were hiding something about the first two days, a total of 200 enrollments. an overwhelming number of people who are enrolling as we have just shown here, enrolling in medicaid and not obamacare and this is absolutely disruptive of the model that obamacare, the affordable care act is based upon. >> right, it's one of the reasons that this is one of the most insidious laws ever devised is about. deceitful, deceptive, alive. it's supposed to be affordable and empower the consumer and really you are trapping more

people as indicated by the tens of thousands into a government program. the government can control you and in this case, what kind of health care you get and that is why this is so bad. the democrats even admit to that. president obama has not admitted that to us yet, but here he read had me sit obamacare is a step toward wt we call -- what he calls a single-payer health heae system. what does he mean? where the government pays and when the government pays for your health care, they get to decide what kind of health care you get and how much and etc. and they control what kind of doctor that you see and if you see a doctor in all and if you get a surgery or not and you're in control of you and that is why this is such a bad law and a lot of us have been fighting at every opportunity we can to get this lot different than the way

it. lou: looks like obamacare itself has been a better disruptor than the republicans in assaulting the program, certainly. we are looking at a potentially potential disaster. this includes state taxpayers and massively so because the ratio was about 927. with the obamacare folks, and what they have put together. that is in terms of enrollment and we are looking at ratios of 10 to one and that means more costs to states and moving to the younger category and younger premium payers that would be supporting older insurance users and it looks like the entire

model is falling apart before our very eyes. >> doesn't mean we can't multitask. there were some other words like disruptive and so forth. and even if it does fall on its own, that is great, it is expected to cost or add $2 trillion to our dead and that leads us to next isue and that is what to do about this debt in our deficit and what to do about a budget. lou: use it on the super committee. >> yes,use it on the super committee. >> yes, i do, but i am an ally and a lieutenant of paul ryan. i'm trying to help him as much as possible. lou: why would congressman paul ryan get involved in integration

and trying to rewrite the tax code in such a short timeframe and as i was talking with jon barrasso yesterday, the leadership priorities are to preserve sequester and ensure that no taxes are raised here. why expand again -- it's one of those baffling things to me that the republican party always seems to be inclined to turn potential political victories in moments of achievement into failure and i just don't understand it. >> he is focused on this budget negotiation and i don't think there'll be there will be a grand bargain. we are focused on not only keeping victories like this in place but adding to them as well

and tax reform would be a victory that would help grow the economy and help alleviate the deficits. lou: but we are sitting here looking at this. >> cannot speak for him, but we are focused on trying to get a budget done and when you don't have a budget is when you have this continuous resolution. lou: goes back to what i was saying. >> earlier i said that it's okay to say no when no is what is %from people so we are borrowing from people so we cannot want a plate and that is what we are setting up against. not only is it a fiscal issue, but also a situation where no is

of the american public. >> yes, indeed. what is needed and what we have not had is a comprehensive strategy for how the united states is going to defeat its enemies, those you are and have been waging war against. if we think of it as -- lou: if i may interrupt you. the bush administratton did not have such a strategy. the obama administration does not have such a strategy. in fact among vice president biden was on the hill, as you know, yesterday trying to talk congress into reducing sanctions against. the reality in washington is quite different from what you see as the panacea. >> there is no panacea, but you cannot win a zero war unless you have a strategy. i am all in favor of drones. but it is a weapon, not a strategy. you have to look at your enemies and decide how you strategically can go about the task of defeating them over some amount

of time. if you think of these as the fires breaking out and try to put them out to monday need you will never succeed. the bush administration did not have a comprehensive strategy. a war against terrorism. a weapon. it is high time we got very serious about the enemy and thought about how we win this and how they lose it. lou: i am smiling because as you call for a comprehensive strategy against al qaeda in the united states in the middle east, we have had two presidents now in session he will not even name the enemy let alone set a strategy for its defeat. namely radical islamists. >> absolutely right. you have to start there and then proceed. lou: always good to talk with you. come bac soon. much more on the president's foreign policy and its failures with the "a-team" next. stay with us.

state hillary clinton. the last time the federal government delivered a new health care benefit to more than 40 billion people, our next guest was in charge, health and human services secretary when the bush administration unveiled medicare part b some seven years ago. joining us is michael levin, former governor of the state of utah, a former envirmental protection agency administrator. it is great to have you with us. >> thank you. lou: great to have you here. i have to ask you how you feel when you watch kathleen sebelius being grilled by congress. are you empathetic or -- what are your emotions? >> i did have some sympathetic pains. a person who has been in that chair. it is a demanding place for anyone to be in front of the energy and commerce oversight committee for three hours under oath is a delicate and difficult thing, but it is the process. and so i recognize that.

lou: does it ease the pain and it when you hear an outrageously, i think, comparisons to the rollout of the medicare part b program that you headed that to the absolute disaster that is obamacare? >> the difference was we fix the system, and it turned that to be something that people both enjoy, i appreciate, and value. the jury is still very much doubt on how this will resolve itself. they are correct to say that there were problems in the early days. we expected that there would be, but we went straight forward and said we will find them, fix them, make the system work, and we did. we will find out in the next few weeks whether the obama administration succeeds at the same thing. we will know in march with are

not -- how history will judge obamacare. lou: how do you judge obamacare, right now the relationship of government to all of the insurance companies that are now inextricably depended upon and related to a government program, and it looks as though there is significant model problems. by that i mean, as you know, the vast majority, the vast majority of enrollees are going into medicaid creating tremendous burdens for state government as well as the federal. very few people and arguably so few that it will threaten the idea that young people will be paying the way for all the people under obamacare. >> we have known from the beginning that there were some technical flaws and ideologic misdirection in the obamacare

bill. i think it is playing out a way that many thought it would. it is way too much government, far more money than we can afford, and the implementation up to this point appears to be hope -- poorly handled. lou: want to turn to the epa. you ran it once. the supreme court hearing a challenge on the epa power to regulate greenhouse gases. today the president signing an executive action -- i want to get this word correct, as were incorrect, can we put out that full screen just to give us a sense of -- i'm sorry? i am told we don't have a full screen. what do you think of a court case and the idea that the president is now using an executive action to go after -- to go after global warming? >> i've learned very quickly that the environmental

protection agency, it is an important mission, but it is an agency that has more power than a good person needs or a bad person ought to have. and i think what we're seeing is through the power of the executive, the already considerable powers of that agency being expanded beyond what is healthy or good and ultimately it will be serious. it is a governance problem for the president to use those powers in the way that he is. lou: lastly as we wrap up, any counsel for the republican party. >> they have to be practical and deal with what is in front of them. the obamacare, the whole fiasco

. in 2011 he issued an executive order to halt deportations of hundreds upon hundreds of thousands of illegal immigrants. he cannot get anything done on gun-control. twenty-three executive orders trying to tighten gun laws. he can't get server security legislation through either. he used an executive order to establish new cyber security standards and has not done bynum anything on education in this country except issue an executive order. he refused to do anything on entitlement reform, so he issued an executive action getting the federal requirements for welfare perigee cannot get anything done so far on climate change. he is issuing a new task force on climate change. this is the language of government.

the task force on, unpreparedness and resilience. with a title like that it has to be better than doing anything about the issue. joining us now, the "a-team," national review columnist, former hillary clinton adviser, co-founder of define american, fox news contributor. weekly standard executive editor do you see this as a stalking horse? you don't have this come out, a colossal failure in the beginning. it may never work.

i don't think this leads to a single payer system. a very bad clumsy bureaucratic inefficient health care system this is just not on the president's way. lou: we are watching medicaid enrollees seven, ten to one state-by-state. >> we are at the very beginning of this new. you don't look at christmas sales in august we have several months. he knew it would take time for the stick again.

[inaudible conversations] lou: can we be adults here and answer the question and deal with the facts. i understand the talking points. they are all passed by large bipartisan majorities. >> republicans, reasonable. lou: your thoughts. good lord almighty. the idea that this program is unfolding the way it is. it looks as though the model itself is broken. >> a dozen democrats in the senate are calling for a delay in major parts of obamacare, not willing to wait. max baucus who was good enough to tell us i see a train wreck coming. we may haveo delay things, change the insurance being dropped by millions of americans

a promise not cab that people could keep the insurance that they wanted. lou: the additions to medicare, is that the time frame you are thinking we have to give this? is there any way in which you would call the president and this administration accountable for screwing up? >> absolutely they should be held accountable. from a media standpoint we cannot just top and say coneys to be fired. we have to focus on the merits of the program. lou: stop. you have to focus as well on the reality before you, a guy who is not talking about firing kathleen sebelius, not talking about the technical issues. that is long since done. i am talking about the model itself. we're talking about another part of the problem. higher deductibles for people who desperately have the money to pay them and higher premiums

that are resulting from a program that was supposed to make this -- i think the name is affordable care, right? >> yes. there are huge problems. this past week it has been the worst of all. even worse than the first week for obamacare. we come down to a situation where probably more people are losing their health insurance, signing up for health insurance under obamacare. the president's credibility has been shattered. he said over and over again that before obamacare was enacted and afterwards that nobody would lose their health insurance if they liked it. now it turns out that they -- the only thing that matters is whether president obama likes their health insurance are not in the more important, democratic unity is being shattered. and he now says that obamacare is like come to dougie. of course, we remember you could not be put back together.

lou: it will be interesting and destructive as the senator said got to see whetherr not they make that determination or frighteningly go to the extent that you suggest in your opening remark, that is, create a horrible bureaucracy that destroys a very good health care system and makes whether the problems are with our current system even worse. how do you tnk that -- have you think this concludes? where will we be? the republicans now want to talk about budgets and deficits rather than dealing with the fact that one year from this month we will have an election thatill answer a lot of the questions on policy in the country's direction. >> the flaws and obamacare are becoming evident. the republicans have not put enough investment in proposing a clear alternative that will actually help people lives. for example, medicaid is going to be horrible medicine for the people did get.

motivation, if you will. is interesting, amongst all the tribes in the country, that they take it upon themselves to express their disapproval of the name and their offense. it seems like they had to work to get to it. >> well, i think the day and age that we live in the culture of the society is much different than 80 years ago. there is tradition and history. they feel it was a badge of honor. certainly today the new washington national team, the baseball team, if they wanted to call themselves the redskins there would be outraged and major league baseball wld step in and say this release not a good idea. if they were to do it today and do not think it would get through, but when you base it on the fact of the history and other names that have in the names in the indians, braves, warriors, so forth, i think it fits the motif because of the

history in the tradition. but those people are offended, and you cannot tell people how to feel. lou: you can't, nor should you, but i do think it the same time there are a lot of feelings on the issue as you correctly constructed. a historical and cultural contexts that goes beyond those folks. i want to turn to the idea of the fcc proposing eliminating the blackout rules. how big a deal is that? >> it is an interesting thing. obviously when done its share of the different purpose. probably now should be refined or redefined. you cannot have an empty stadium , so there must be some percentage of stitch -- tickets sold. the national football league will need the revenue. you don't want a studio show, an empty stadium where is only being played for television. it takes out the excitement. i think there are a lot of fancy cannot afford the game coming in for free, and some of the rules are dated and it needs to be

refined. i cannot think it should go away altogether but needs to be simplified where there is a lesser standard, unless the threshold ifou will because a lot of fans, you can have 98 percent of the seats sold or 96% and then the other teams don't buy yen and the whole team is blocked out. lou: i happen to agree with you. this now looks like mortal combat between the two. how is this going to unfold? >> my opinion is he is going to lose. this standard than the threshold is such that they have been mailed otherwise there would not have gone down this path. he is an embedded steroid user he admitted it then and has been caught now. the institution will win. i do not think that there is any way, shape, or form that at the
